1. SaaS In-App Subscription Refund Framework
CommandCenter Pro is enterprise educational management software delivered as an instant digital service. Subscriptions and station node activations are governed by the following refund rules:
✓ 7-Day Technical Failure Refund
If a client purchases a subscription and encounters a verified fatal system failure (e.g., student admission data loss or inability to generate fee bills) that TBATECH engineering cannot remediate within 7 business days of formal written bug submission, a 100% full refund is issued immediately.
✓ 15-Day Free Evaluation Trial
Every educational institution receives an unrestricted 15-day free evaluation period to explore fee registers, marksheet generators, timetable tools, and caller HUDs before making any commercial financial commitment.
Conditions Governing Refund Requests:
- Instant Digital Goods Delivery: Software licenses, Station IDs, and Cloud Node provisions are digital goods provisioned immediately upon transaction confirmation; change-of-mind cancellations are not eligible for refund post-activation.
- Non-Refundable Line Items: Initial one-time domain configuration charges, server provisioning costs, third-party payment gateway transaction fees (2–3%), and custom biometric setup fees are strictly non-refundable.
- Prorated Annual Cancellation: Institutional annual plans cancelled after 30 days due to verified school closure are refunded on a prorated basis for unused whole calendar months, calculated at regular monthly tariff plus a 15% administrative closure fee.
- Refund Procedure & SLA: Refund requests must be emailed with Station ID and transaction invoice to info.tbatech7@gmail.com. Refunds are credited within 5–7 banking days via the original payment route.
2. Master Terms of Use & Director Responsibility
- Station ID & Password Custody: The Director is solely responsible for maintaining the confidentiality of the Master Password and Station ID. TBATECH is not responsible for unauthorized actions resulting from compromised credentials.
- Acceptable Use & Communication Ethics: Use of WhatsApp or SMS dispatch tools to communicate with parents must strictly comply with local telecom regulations and TRAI guidelines. Unsolicited commercial advertising or spamming is strictly prohibited.
- Subscription Lapse & Lockout: Accounts with unpaid subscription renewals will enter read-only mode after a 7-day grace period. Cloud data is safely archived for 60 calendar days before automated retirement.
3. Limitation of Liability & Legal Shield
To the fullest extent permissible under the laws of India, TBATECH, its developer Akash Maurya, and affiliates disclaim liability for indirect, punitive, or consequential damages resulting from local smartphone hardware failure, operating system incompatibility, cellular network outages, or accidental record deletion by local device operators.
4. Governing Law & Buxar Jurisdiction
This Agreement is governed by the laws of India. The parties irrevocably submit to the exclusive territorial jurisdiction of the competent Civil Courts located in Buxar, Bihar – 802101, India for the resolution of all disputes.
